These General Terms and Conditions (GTC) apply to all contracts concluded between Red & Black - Premium Motors (hereinafter "we" or "seller") and the customer (hereinafter "you" or "buyer") for the sale of vehicles and related services. Deviating terms of the customer shall not apply unless we expressly agree to them in writing.
The presentation of vehicles on our website does not constitute a legally binding offer. By submitting an enquiry or order, you make a binding offer. A contract is only concluded when we confirm the order in writing (e.g. by e-mail) or by delivery. We are entitled to refuse orders without giving reasons.
All prices are in euros and include statutory VAT unless otherwise stated (e.g. "net"). Payment terms (e.g. deposit, balance, bank transfer, payment on delivery) are agreed individually. Unless otherwise agreed, prices are ex works or as stated in the vehicle description (e.g. "to port"). Additional costs (transport, registration, etc.) will be communicated separately.
Delivery times are non-binding unless we have expressly agreed a fixed date in writing. We are not liable for delays due to force majeure, transport or official circumstances. Partial deliveries are permitted. The risk of loss or deterioration of the goods passes to the buyer upon handover to the carrier or upon collection.
Statutory warranty rights apply. For consumers, the limitation period for warranty claims is two years from delivery. For businesses, the warranty period is 12 months unless otherwise agreed. We do not give guarantees beyond the statutory provisions unless expressly agreed in writing.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and in cases of mandatory statutory liability. For slight negligence we are liable only in the event of breach of essential contractual obligations (cardinal obligations) and only for foreseeable, typical damage. Otherwise liability for slight negligence is excluded.
We process your personal data in accordance with our Privacy Policy. By placing an order or making an enquiry, you consent to the data processing required for the performance of the contract.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of performance and exclusive place of jurisdiction for disputes, if you are a merchant, is our registered office. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
